After spending an entire morning waiting for my # to be called I got to the wicket and was told that T3 was not the proper form for Discontinuing a Service, that it was probably a T2.
So, I went and placed my name on the list for seeing a Counsel (free) for advice. She looked at my documents and agreed it was a T2 I should fill out, which is more difficult because it requires explanation of reasons etc. But It Is FREE.
The T2 has a kind of catch-all; "3. The landlord, and the landord’s agent or the superintendent seriously interfered with your reasonable enjoyment of the rental unit or the complex." (In other words, Landlord changed the term of the tenancy without my consent).
Now if we should go ahead with a T2, I do not want ‘compensation aka $$, but rather the remedy we seek is Part 3: Remedies 2. The landlord, the landlord’s agent or the superintendent must Stop the activity that led you to make this application. I would ask for reimbursement of my subway tokens.
This change in procedure is a good one: There was no way to represent the entire building with the T3, with the T2 there IS!
It is up to us to decide what to do. It would be 4-6 weeks for a Hearing. I was also told by counsel that if I could find one of our disabled tenants who filled in under the Reasons how Paid parking affects their life, for eg., needing a Red Cross Nurse who comes in to visit them, then surely one of the people on the Hearings board would immediately recognize that is a Human Rights Violation, which would give more power to the application on our tenant rights.
An example of what I would write under Reasons : There are several disabled tenants who have been negatively impacted in particular. So and so, _____ in #__ requires a daily visit from a nurse who uses the visitor parking – (Talk more about Impact, not wordy/just effective) The landlord has a duty to accommodate these disabled tenants to the point of undue hardship. The landlord has not articulated a clear rationale for eliminating the free visitor parking.
